Timeline of the U.S. Olympic Committee's (USOC) Pursuit of

Jason Bausher for using the word "OLYMPIC" in "Best of the Olympic Peninsula"

1/9/2007: Initial letter from USOC lawyer Kelly Maser to Jason Bausher (CLICK HERE TO DOWNLOAD)

  • CLICK HERE for a copy of the abridged version of the Ted Stevens Olympic and Amateur Sports Act sent with this letter. While supporting the claim by the USOC that it could "file a civil action for unauthorized use", notice that the "Preexisting Rights and Geographic Reference" section (d) of Section 220506 makes an exception for "business, goods, or services operated, sold, and marketed in the State of Washington west of the Cascade Mountain range."

2/6/2007: Second copy of initial letter from USOC lawyer Kelly Maser sent to Jason Bausher (CLICK HERE TO DOWNLOAD)

2/7/2007: Jason's email response to USOC lawyer Kelly Maser (CLICK HERE TO DOWNLOAD)

2/8/2007: 18-minute phone conversation between USOC lawyer Kelly Maser and Jason Bausher--a conversation initiated by Jason

  • Kelly Maser claimed that she worked for her sponsors and athletes in a "non-profit" organization
    • To see lists of these sponsors such as Budweiser, McDonalds, Coca-Cola, Johnson & Johnson , Panasonic, GE, Eastman Kodak, and Visa, go to http://www.usoc.org/12956.htm.
  • Jason repeated his position that he was not competent to evaluate the legal document the USOC is demanding he sign, and he repeated his position that he lacked the financial means of securing competent counsel. He agreed to put disclaimers on the web site and pointed out that no confusing language or images were being used.
  • Jason repeated his position that he was not competent to evaluate the USOC claim that the trademark application was not worthy of registration, and he repeated his position that he lacked the financial means of securing competent counsel. He explained that he would allow the independent third-party U.S. Patent and Trademark office to decide the legitimacy of the application.

2/11/2007: Jason's follow-up email response to USOC lawyer Kelly Maser (CLICK HERE TO DOWNLOAD)

2/15/2007: Email response from USOC lawyer Kelly Maser (CLICK HERE TO DOWNLOAD)

2/27/2007: Email from USOC lawyer Kelly Maser (CLICK HERE TO DOWNLOAD)

3/6/2007: Email from Carol Gross of USOC Legal Affairs (CLICK HERE TO DOWNLOAD)

3/6/2007: Phone message from Carol Gross of USOC Legal Affairs (CLICK HERE TO DOWNLOAD)

  • Claims that Jason must comply "if you want to continue using the mark Best of the Olympic Peninsula, however, not the mark, but operating an Olympic business."

4/4/2007: Phone message from Carol Gross of USOC Legal Affairs (CLICK HERE TO DOWNLOAD)

  • Admits to calling Jason's employer, the National Park Service in Olympic National Park, where Jason serves as a ranger: "I actually tried to track you down through the Wilderness Info Center at (360) 565-3100, and they said that you hadn't started working yet for the season so I am trying to reach you at this number."

5/10/2007: 6-minute phone conversation between Carol Gross of USOC Legal Affairs and Jason Bausher. Gross called Jason at 8:57 a.m. without an appointment or a request for the phone call from Jason.

  • When asked if the USOC was going to "take action" against Jason, Gross responded by saying, "That will be decided internally." Gross said nothing after Jason said, "Please let me know now if you are going to take action against me." Gross at no time said that the USOC would not take the action originally put forward in the original letter: a "civil action for unauthorized use" under the Ted Stevens Olympic and Amateur Sport Act.
  • Gross asked if Jason was going to continue using "Olympic" in commerce--a question Jason affirmed: "Yes, I will continue using the word "Olympic" on the Olympic Peninsula. That's our word. Olympic is our word." Gross responded, "We have a problem with that."
  • Gross asked if "Best of the Olympic Peninsula" was being used in commerce--a question to which Jason responded by asking what authority she had to ask about his business affairs.
  • After asking these questions and Jason gave his answers, Gross said more than once, "I'll make a notation about that."
  • Gross claimed that it was "difficult to get in contact" with him--a claim rebutted by the emails and phone conversation listed above.
  • "I assure you [the next time we communicate] it will not be redundant." This was Gross' response to Jason's explanation that he had stopped responding to the USOC when the conversation had become redundant, i.e. the USOC making some demands with which Jason did not feel comfortable complying (signing the form and withdrawing the trademark application).
  • Jason re-stated his original position articulated in February: that he had complied with their wishes for a disclaimer on multiplie occasions and assured the USOC that there were no confusing displays, but he would neither sign their legal document nor withdraw the trademark application without trusted and independent legal representation.

PUBLIC REACTIONS TO OTHER USOC TRADEMARK CLAIMS

"Local company faces down USOC"

Kitsap Business Journal: 4/4/2001

http://www.kpbj.com/headlines/articles/2001-04-04-HED-05.html

“The United States Olympic Committee (USOC) recently engaged in a flurry of strong-armed enforcement actions against local businesses that it claims infringe on the USOC's trademark. That included local commodities broker Chris Reilly of Olympic Asset Management in Port Orchard.”

“Numerous businesses on the Kitsap Peninsula, use the name “Olympic.” The Qwest directory alone lists 79 separate companies in its white pages — and that doesn't include those on the Olympic Peninsula. Many of them, including Olympic Asset Management, received letters from the USOC threatening legal action if the name was not changed.”

“According to Reilly, working with attorney, Stuart Phillips, Olympic Asset Management was able to fit within a loophole to the law. The same loophole should fit most other local businesses as well. If the business is located west of the Cascade Mountain Range and conducts substantially all of its business in Western Washington, and if there is no substantial likelihood of confusion with the Olympic Committee, the business does not have to change its name.”

“USOC Drops the Hammer on Pottery Olympics!”

http://www.tsweekly.com/index.php?option=com_content&task=view&id=208&Itemid=44

Tuesday, 8 August, 2006

“Sources close to the event have informed this reporter that the Bend Pottery Olympics will have to change its name next year after the U.S. Olympic Committee (USOC) came down on it like a ton of legal bricks.

Every year for the last three years, the Central Oregon Community Action Agency (COCAAN) has held the Pottery Olympics to get ready for its big “Empty Bowls” fundraising event in the fall.”

“Jasonville games need new name”

http://www.heraldtimesonline.com/stories/2007/04/27/news.nw-645473.sto

Readers' comments:

“Give me a freakin' break. USOC is just stupid. Like anyone would really confuse these people for ‘real' US Olympic athletes. Get a life Carol Gross.”

“For the USOC, it's not a question of someone confusing this event for the real Olympics. It's a question of whether anyone other than USOC is allowed to benefit from use of the word ‘Olympics.'”

“Failed drug tests, crooked judges and bribery by host cities—you would think the USOC has better things to do than to be fussing about Jasonville, Indiana”

Acropolis Now

Published August 12, 2004 (source no longer extant)

“This Thursday, August 12, [OLA restaurant owner Brian Lieberman] plans to run down Biscayne Boulevard to OLA, carrying an Olympic-type torch to light the Caja China, the barbecue coffin used for the OLA's weekly pig roast.”

“'The USOC is interested in contacting the restaurant owner to provide some background educational information regarding the use of Olympic imagery and terminology, and why it might not be a good idea to feature the Olympic torch in this manner,' huffed Carol Gross of the legal affairs division of the U.S. Olympic Committee.”

Orwellian Olympics

http://www.metafilter.com/44346/Orwellian-Olympics

August 16, 2005

“I'm starting to hate the Olympics.”

“Jesus, there's protecting your trademarks and then there is the Olympic committee. They are insane, and I can't believe they require special laws to protect their stupid generic marks.”

“This is so damned sad. I remember when the Olympics were about grace and triumph and determination, and most of all, peace.”

"Brown Duck Olympics Need New Name

U.S. Olympic Committee cries foul at use of title for Brown Duck events"

http://www.sports-boards.net/forums/showthread.php?t=113219

“A few weeks ago, Jasonville Board of Parks and Recreation member Jay Criss received a disturbing message from the U.S. Olympic Committee headquarters in Colorado.
It seems that the USOC got word that the Greene County city of 2,472 residents sponsors an event each February that involves locals in heavy canvas coveralls participating in a tongue-in-cheek “Olympic” event.”

“In a news release responding to the controversy, Clark was perplexed about any concern that the two Olympic games might be confused. He said his city's competition, during which he hands out medals to winners standing atop hay bales, “‘certainly did not try to deceive or mislead people into believing that the games had any connection to the USOC.'”

Bush Campaign Refused to Pull Olympic Ad

Published on Thursday, August 26, 2004 by the Associated Press

http://www.commondreams.org/headlines04/0826-05.htm

“ATHENS, Greece - President Bush's re-election campaign refused a request by the U.S. Olympic Committee on Thursday to pull a television ad that mentions the Olympics.”

“The International Olympic Committee and the USOC have the authority to regulate the use of anything involving the Olympics.

"'We own the rights to the Olympic name, and no one has asked us, said Gerhard Heiberg, the Norwegian IOC representative and IOC market commission leader.”

2010 WINTER OLYMPICS: USOC VS. WESTERN WASHINGTON

Governor Christine Gregoire and other policymakers plan economic development from the 2010 Winter Olympics. Yet how can we make money on the Olympics if the USOC will not allow us to use the word "Olympic?"

“Washington: Gateway to 2010

The Official Website for Information and Resources on Washington State's 2010 Task Force and Related Activities”

Available at: http://www.exportwashington.com/portal/alias__2010/lang__en-US/tabid__0/Default.aspx?init

“ My 2010 Task Force is taking strategic action to maximize opportunities that the 2010 Games will bring to Washington and the greater Northwest region.   The 2010 Games also provide a platform for ongoing dialogue with our Canadian neighbors on issues of mutual interest, including border crossing and security, transportation, international trade, and workforce development.  I am confident that our collaboration will generate enhanced partnerships and increased growth for Washington and Cascadia as a whole.”

TOURISM

“The 2010 Olympic Games and the associated Paralympics scheduled for locations in Whistler and Vancouver, British Columbia, offer opportunities for Washington and other Pacific Northwest states to enhance their tourism industries and generate other travel-related business development.  The Games are expected to attract a combination of athlete participants, officials, support staff, media and spectators – and will be televised throughout the world. Attendance and participation estimates range from 350,000 to 450,000, with 40-50% of these coming from outside of British Columbia.”

Governor Gregoire's 2010 Task Force - Impact Study Overview

Available for download at http://www.exportwashington.com/portal/alias__2010/lang__en-US/tabid__3479/DesktopDefault.aspx

June 20, 2006

Recommendations:

Given this expected range of opportunities, Washington can work locally and regionally to promote 2010 ticket sales and encourage tourism through Washington before, during and after the games.

Specific Recommendations include:

•  Regional collaboration with VANOC, Tourism BC and Tourism Canada, and PNWER (Pacific Northwest Economic Region):

•  Exchange of tourism research to be deliberate and strategic with two nation promotion investments and decisions. Two-Nation Vacation promotion to support NW tourism before, during and after the games.

•  Collaborate in training facility information and availability for Olympic Teams prior to the games.

•  Create a common media center clearing house and web press rooms to offer stories as an extension of our two-nation tourism promotion.

Jointly market the region, working with tourism agencies in British Columbia, Oregon, California, Idaho and Montana – drive the development of a Cascadia tourism plan.”

Tourism Subcommittee Priority Items for Action Planning

Available from http://www.exportwashington.com/portal/alias__2010/lang__en-US/tabid__3493/DesktopDefault.htm

“Promote Washington as a Gateway for the Olympic Games; market The "Scenic Route" to/from the Games through Washington; promote Two Nation Vacation concept

Create Travel Information Centers -- set up promotional "retail" space in key locations of Vancouver; explore other opportunities.

Attract British Columbia Residents fleeing the "chaos" of the Games.”

Office of Governor Gary Locke
FOR IMMEDIATE RELEASE - September 9, 2004

Available at http://www.digitalarchives.wa.gov/GovernorLocke/press/press-view.asp?pressRelease=1686&newsType=1

“The 2010 Olympics represent great opportunities in trade, tourism and economic development for Washington state,” Locke said. “The large influx of visitors from across the globe – many of whom will travel through Washington – are also likely to create major impacts in security, transportation, and other infrastructure.”

Day Hikes Day hikes are a safe, easy way to gain the skills you will need to stay safe in the wild--all while learning about the natural and social history of the area. You will learn about the 10 Essentials, map and compass, trip planning, risk management, and staying found. Your Guide will lend you a kit with some of the Ten Essentials, and you will hike +/- 7 miles while learning about Olympic National Park. Trips do not leave every day, so Reserve Your Spot Today!

Backpacking Backpacking sweeps the backpacker into the wild world of wilderness with all its grandeur and intensity. Backpackers can hike for almost as many days and almost as far as they want: for example, from Staircase in the southeast corner of the park to the Grand Valley in the northeast, from the Dosewallips in the east to Quinault in the west, or from Elwah in the north to Sol Duc in the west. Consider these routes for your ultimate wildnerness experience. Then Reserve Your Spot!

Leave No Trace (LNT) Trainings Leave No Trace is the national standard for outdoor recreation ethics from a conservation perspective. The Leave No Trace Center for Outdoor Ethics has established two main basic trainings in LNT: Awareness Workshops and Trainer Courses. Awareness Workshops last only a couple hours and offer little or no outdoor training. Trainer Courses are an intensive overnight experience with some backpacking. Reserve Your Spot for the course that's right for you.

Scouting Guide and owner Jason Bausher is an Eagle Scout, Vigil Honor recipient, and is Wood Badge-trained. He can advise your troop about 50-miler hikes, the Leave No Trace Awareness Award, and merit badges such as Hiking, Backpacking, Camping, and Climbing. Jason can also serve as a liaison with the National Park Service to organize work parties or service projects in Olympic National Park. PLUS: Grays Harbor Boy Scouts receive FREE TRAININGS! Reserve Time for Your Program.

Service Tourism on the Olympic Peninsula will only last if we work to conserve the resource by doing trailwork, raising money for political action, and by teaching wildness to the generation to whom we hand over the earth. Sign Up Today to do or give what you can for the preservation of our children's earth. Where are your talents? Clearing trails? Educating National Park visitors about Leave No Trace ethics and practices? Raising money from friends, family, and business associates? Leading Boy or Girl Scouts? YOU CAN HELP!!!

Mountain Seminars Do the mountains, rivers, and glaciers of Olympic National Park merely form one big playground, or is wilderness essential to our Being as embodied Beings in the world? Jason Bausher works on questions such as this in his environmental philosophy, and he shares his research in mountain seminars. He received his master's degree in theology from Yale University and is finishing an M.A. while in a doctoral program in philosophy. Check out a few of the seminars. Don't see your burning "big questions" being asked on this list? Email Olympic Mountain School for a custom program.
